Illegal Alien On Trial For Killing Mollie Tibbetts Says ‘Constitutional Rights’ Violated

This case is a sheer travesty of justice any way you cut it. On July 18, 2018, University of Iowa student, Mollie Tibbets, age 20, went out for a jog in Brooklyn, Iowa and disappeared. It turned out that she was stabbed to death by an illegal immigrant named Cristhian Bahena Rivera, then 24. It took them a month to find her body in a cornfield covered by corn stalks. Rivera confessed.

Surveillance camera footage showed Rivera’s car following Tibbetts. Rivera was charged with first-degree murder and is being held on a $5 million bond. He was stalking her and coming on to her. Mollie threatened to call the police on him and Rivera claims he blacked out and killed her.

According to Breitbart News:

“Rivera told police that Tibbetts was jogging when he saw her, according to prosecutors. That is when he said he approached Tibbetts and started talking to her. After Tibbetts told Bahena Rivera that she would call the police if he did not stop following her, the illegal alien allegedly chased her and says he “blacked out” after this.”

Yeah, he blacked out, killed her, stuffed her in his trunk and took her to that field to hide the body. I was never clear on whether he raped her or not but it was headed that way.

Rivera lived in the county, an area which is surrounded by sanctuary cities, and with a “stolen ID and social security card,” he had found work at a local dairy farm.

He’s being represented by not one, but two tax-payer funded attorneys, Chad and Jennifer Frese. They filed a 29-page motion which was obtained by the Des Moines Register. They claim that Rivera’s constitutional rights were violated because the local Iowa police who questioned him failed to make it “clear that he could have contacted the Mexican consulate before speaking to law enforcement.” What bull crap. If that was true then as a non-citizen he does not have constitutional rights because he is a foreign citizen.

The filing states:

“Providing this information to Bahena Rivera — a confused, exhausted and vulnerable Mexican national was seeking trustworthy help — would have triggered an invocation of consular notification and a decision to await the consulate’s assistance before making any other statements.”

From RedState:

“They also claim that Rivera was not read his Miranda Rights “until hours into a 12-hour interview — a violation of his constitutional rights that they claim should nullify his alleged murder confession.”

“The attorneys wrote that he has “very limited Mexican education” and is “wholly unfamiliar with the U.S. criminal justice system.”

“The case is due to go to trial on November 12 and has already been postponed once as Rivera’s attorneys try to have his confession thrown out of the case. They have already managed to “move the trial to a less white, more Hispanic-populated county in the state.”

“Should Rivera’s confession be thrown out because he wasn’t read his Miranda rights until several hours into his interview? Should he escape punishment because police forgot to read them for a few hours?

“I am not a lawyer, but it’s possible the police did not arrest Rivera until several hours into questioning because that is when they determined he was the killer.

“The law states (and I’m sure that exceptions apply) if an individual is not read their Miranda rights, the evidence gathered cannot be used to establish guilt in court.

“What happens then in the Rivera case, when the rights were read several hours into the confession? The court filing indicates that, at some point during the interview, he was read his Miranda rights.

“Rivera then continued speaking to police for several more hours, signed his confession and then led police to Tibet’s body. The fact that he murdered her is not in question.

“This case opens up the hot debate between liberals and conservatives over just which constitutional rights people who enter the U.S. illegally are entitled to. Certain basic human rights apply to citizens and non-citizens alike, but should undocumented immigrants receive the full constitutional rights an American citizen would?

“Should American taxpayers be forced to pay for Rivera’s legal representation?

“Finally, and most importantly, what about Mollie Tibbetts’ constitutional rights?”

No… illegal immigrants should not have the constitutional rights that Americans enjoy. No… we should not have to pay for his attorneys.

And what about Millie Tibbetts’ constitutional rights? They have totally been forfeited because he murdered her in cold blood. This is ridiculous. There is no doubt he murdered her.

Are we really going to let two scumbag attorneys get this killer off? Where’s the justice in that? Nowhere, that’s where. Torches and pitchforks anyone?

At least 52 homicides were been reported throughout the city as of March 2, according to a tally by The Baltimore Sun. The major northeastern city in Maryland of more than 600,000 people is one of the most dangerous in America, according to the FBI.”

According to the Baltimore Sun, there have been at least 133 shootings this year, 46 of them were fatal.

“The city ended 2019 with 348 homicides, its fifth year in a row with more than 300 slayings and the second-deadliest year on record.

The city’s string of killings so far in 2020 has Baltimore already on track to surpass 300 homicides for yet another yet, according to FOX45.

“This city was never like this, even when it was at its worst,” activist Tyree Moorehead told FOX45 on Sunday. “That’s scary because there’s people whose family members haven’t been shot yet that have a bullet with their name on it and don’t even know it.”

Residents and community activists are hoping to bring back a community that’s disengaged. The Rev. Alvin Hathaway told FOX45 too many in the city are going around treating the violence “like this is average, like nothing is different,” and that community members need to step up and “be the change.”

“You have a whole host of people who are feeling like they’re afraid,” Hathaway told FOX45. “This is red flag time. We’ve got to call all hands on deck and pull the city together.”

Homicide count exceeds 50 in first three months of 2020

BALTIMORE (WBFF) – Only three months into 2020 and more than 50 people have lost their lives to violence in the City of Baltimore.

The city’s 50th homicide, which happened Friday night, came and went without many even noticing.

“This city was never like this, even when it was at its worst,” activist Tyree Moorehead said. “That’s scary because there’s people whose family members haven’t been shot yet that have a bullet with their name on it and don’t even know it.”

Baltimore is on track to surpass 300 homicides for the fifth year in a row.

“You have a whole host of people who are feeling like they’re afraid,” Rev Alvin Hathaway said. “This is red flag time. We’ve got to call all hands on deck and pull the city together.”

Community activists say waiting on city government to make a change isn’t helping anyone and that each neighborhood needs to do its own part.

“Right now people are going around like this is average, like nothing is different,” Moorehead said. “We need to be the change and we need to believe.”

Border Patrol Agents Arrest Child Sex Offender Illegally Re-Entering U.S.

Thank God for our Border Patrol. Sanctuary politicians are working against them, like in Maryland where the 9th illegal alien sex predator has been arrested, but our Border Patrol & ICE agents are scooping them up as fast as they can.

Fox5 San Diego is reporting:

SAN DIEGO — U.S. Border Patrol agents arrested five people Saturday night who were involved in a human smuggling event, officials said. Included in the group was a man who had two prior felony arrests and more than 10 years of prison time.

At approximately 9:30 p.m., Border Patrol agents near Tecate, California, observed a suspicious vehicle traveling on State Route 94. The driver noticed an agent behind him as he drove his 2012 Chevrolet Cruze, officials said. He tried to swerve out of the way of the agent but was blocked by another car.

The agent pulled over the suspicious sedan and questioned five people in the car. Three passengers in the backseat claimed to be from Mexico and said they did not have documentation that allowed them to be in the U.S., agents added.

All five were arrested and taken to a nearby station. During routine processing, it was revealed that one of the men who claimed to be a Mexican national was actually from El Salvador and had a criminal history, which included indecent liberties with a child and possession of a controlled substance.

The driver and front passenger, who are U.S. citizens, face human smuggling charges and the El Salvadoran man faces Federal charges for criminal re-entry. The vehicle was seized by the U.S. Border Patrol.
