Supreme Court Justices Impeached After Their $3M Liberal Scandal Is Revealed

Who exactly presides over the impeachment trial of a state Supreme Court justice if the entire state Supreme Court is being impeached? It is an absurd constitutional conundrum that West Virginians are being forced to grapple with.

In an extraordinary and unprecedented move, the West Virginia House of Delegates voted to impeach all four state Supreme Court justices for spending issues and abuses of authority. The list of abuses is long and lengthy with allegations ranging from million dollar office renovations, personal use of state vehicles, lying, cheating, outright theft of state property, and a  laundry list that is as appalling as it is sad.

Five justices sit on the state Supreme Court in West Virginia. The state legislature has drafted articles of impeachment against Chief Justice Margaret Workman and Justices Robin Jean Davis, Beth Walker, and Allen Loughry. The court’s fifth justice, Menis Ketchum, retired in late July prior to articles of impeachment being drafted. He will plead guilty to two federal corruption charges on August 29, 2018.

The state House of Delegates voted to impeach Justice Allen Loughry on eight articles, setting the stage for a trial in the state Senate. He was placed on unpaid administrative leave in June after a state commission lodged a 32-count complaint against him, alleging pervasive violations of the state ethics code. He has since been indicted in federal court for 23 counts of fraud, witness tampering, and making false statements to investigators.

The remaining three justices — Workman, Davis, and Walker — face impeachment for wasting government resources and failing to effectively administer the state courts. All three spent large sums of taxpayer dollars on lavish improvements to their chambers in the state capital, which cumulatively totaled almost $750,000, and allegedly abused state travel resources.

Walker was the final justice to be impeached when an article was approved stating all four justices abused their authority, citing failure to control office expenses, including more than $1 million in renovations to their individual offices, as well as not maintaining policies over matters such as working lunches and the use of state vehicles and office computers at home.

Davis was impeached for $500,000 in office renovations, though Walker originally dodged impeachment when lawmakers decided to overlook her $131,000 in spending on office renovations. A short time later, another article was withdrawn against Workman, who also spent $111,000 in renovations. Workman and Davis also allegedly authorized compensation for other state judges in excess of the amounts allowed by West Virginia law.

Interestingly enough, prior to this summer’s series of events leading to the mass impeachment of the entirety of the West Virginia Supreme Court, Davis was cited in the press for potential ethics violations in unrelated matters. In March 2017 a series of contributions made to her 2012 re-election campaign strongly resemble an illegal straw donation scheme entirely conducted at the behest of an attorney, Michael Fuller of the McHugh Fuller Law Group while defending a $92 million civil judgment in the state Supreme Court. That very same attorney also purchased the Davis family private jet in December 2011. Davis then, in turn, issued a ruling in 2014 preserving a large portion of Fuller’s $92 million award, as reported by the Daily Caller.

Lawmakers also approved articles of impeachment against Loughry for spending $363,000 in renovations to his office; having some $42,000 antique desk and computers all owned by the state at his personal home; lying to the House Finance Committee about taking home the desk along with a $32,000 suede leather couch also owned by the state; and for his personal use of state vehicles. Though another impeachment article was withdrawn dealing with an accusation Loughry used state money to frame personal items at his office.

Loughry, Workman, and Davis also were impeached for their roles in allowing senior status judges to be paid higher than allowed wages. Lawmakers say the overpayments violated state law and stopped when they were challenged by the Internal Revenue Service.

What is even more appalling is these four justices worked in a state where the median household income from 2012-2017 was approximately $42,644, according to the US Census Bureau. Compared to the median US household income it ranks more than $14,000 lower than the average in the rest of the nation and West Virginia is ranked as the third poorest state in the nation as a whole. Yet these people felt it appropriate to live the high life on the backs of those that have little to start with.

Delegate John Shott stated during an August 7 judiciary committee hearing -“There appears to be, based on the evidence before us, an atmosphere that has engulfed the court of cavalier indifference to the expenditure of taxpayer funds, to the protection of taxpayer-paid assets, and an almost incomprehensible arrogance that for some reason they are not a coequal branch but a superior branch of government.”

In answer to the question of who presides over the impeachment trial when entire state Supreme Court is being impeached, the answer lies within West Virginia’s constitution. It provides that the chief justice shall preside over impeachment trials in the state Senate. However, as Chief Justice Workman herself is also subject to impeachment, she is therefore ineligible to preside, as are the rest of her colleagues.

In that vein, Workman appointed Cabell County Circuit Judge Paul Farrell to the high court on an interim basis late Friday. Farrell will serve in Loughry’s seat, pending the election of a successor in November. Farrell will also preside over impeachment proceedings in the legislature, although Walker disputes his power to do so.

Walker argued against Farrell’s installation as the presiding officer for impeachment issuing a short statement late Friday, stating – “I believe it is improper to designate any justice as acting chief justice for impeachment proceedings in which I or my colleagues may have an interest and that have not yet commenced in the Senate.”

Trump: ‘Hard To Believe’ Obama Didn’t Know What FBI Was Up To In 2016

President Trump said Wednesday that “it would certainly be hard to believe” that former President Barack Obama was unaware of what the FBI was up to in 2016. Well, of course, he knew. In fact, I would wager he orchestrated all of it. Obama is not dumb or incompetent. I’m almost certain he was pulling the strings and running the war room here.

Attorney General William Barr held a press conference today as the lightly redacted Mueller report was released. He put to rest the conspiracy theories and quelled the rabid Trump hatred by pointing out there was no collusion with the Russians or obstruction of justice. Trump tweeted out, “Game Over!” Indeed, it should be but the left will never give up this bone.

Trump praised Attorney General William Barr, saying “he’s grabbed it by the horn.” It would certainly seem that he has. The guy is fearless. Now, the left is calling for Mueller to have to testify over all this. No matter what they do it won’t change the fact there is no there-there and they are not going to get any dirt on Trump. Give it a rest already. Two years and millions of dollars later, they have nada.

“The conversation turned to several former Obama-era officials, most of whom are likely to be investigated in the coming months as Barr has pledged, and Trump touted the fact that he had called attention to them as “one of my great achievements, actually.”

“The president also had strong opinions when it came to whether or not Obama was aware of what the FBI was doing. “How is it possible that he didn’t know?” he asked. “I mean, we’re talking about pervasive, horrible things that were happening.”

“It would certainly be hard to believe that he didn’t know what was going on,” Trump concluded.”

That is the understatement of the century.

“Now that the collusion and obstruction conspiracy theories have been exposed for the pathetic hoaxes they always were, the Obama-era [Department of Justice] and FBI must answer for their misdeeds and the scam that they perpetrated against the American people. Justice will be served,” campaign manager Brad Parscale said. “President Trump has been fully and completely exonerated yet again. Now the tables have turned, and it’s time to investigate the liars who instigated this sham investigation into President Trump, motivated by political retribution and based on no evidence whatsoever.”

“That theme — “turning the tables” on the Democrats — or some variation of it, was what the Trump campaign ran with immediately after Attorney General William Barr delivered the Mueller report to Congress. Team Trump issued a fresh campaign video with that language as it replayed a series of prominent Democrats insisting over the course of the nearly two-year-long Mueller investigation that the president was guilty of collusion.

“Another staple of the campaign’s messaging: “Investigate the investigators.” The Republican National Committee, working in tandem with Trump 2020, was using similar language in series of press releases, as it emphasized that Russian meddling occurred while Barack Obama was president.

“Bottom line: Not only did Mueller confirm that there was no collusion, we also learned the full extent of how much the Obama administration failed to act while Russia messed with America’s electoral process,” read a missive from RNC rapid response director Steve Guest.”

Trump’s 2020 campaign will no doubt use the Mueller report as a political weapon and at this point, it is one of many that the Democrats will gleefully bludgeon themselves to death with in 2020. Forget hoisting yourself by your petard… these morons are TRYING to commit political suicide. It’s glorious to watch. Popcorn-worthy incompetence and radicalism even.

There is no doubt in my mind that the hunters are about to become the hunted here. I suggest they start with Barack Obama because he knew everything that went on and nothing happened during his administration without his blessing.

REPORT: HUD To Crackdown On Illegals Taking Advantage Of Public Housing

Trump is a master at timing. His administration is proposing a new rule to try to block some 32,000 illegal immigrant-led families from claiming public housing assistance, saying it’s unfair to hundreds of thousands of Americans who are stuck on waiting lists. And it is. This is long overdue and I applaud Ben Carson and President Trump on this move.

HUD let Congress know this week that it intends to implement the new rule, kicking off a schedule of publication and notice and comment that could have the plan finalized later this summer. That’s if the darned Democrats don’t get in the way again… which they will. The plan would scrap Clinton-era regulations that allowed illegal immigrants to sign up for assistance without having to disclose their status.

From the Washington Times:

“Under the new Trump rules, not only would the leaseholder using public housing have to be an eligible U.S. person, but the government would verify all applicants through the Systematic Alien Verification for Entitlements (SAVE) database, a federal system that’s used to weed illegal immigrants out of other welfare programs.

“Those already getting HUD assistance would have to go through a new verification, though it would be over a period of time and wouldn’t all come at once.

“We’ve got our own people to house and need to take care of our citizens,” an administration official told The Washington Times. “Because of past loopholes in HUD guidance, illegal aliens were able to live in free public housing desperately needed by so many of our own citizens. As illegal aliens attempt to swarm our borders, we’re sending the message that you can’t live off of American welfare on the taxpayers’ dime.”

“Illegal immigrants’ access to taxpayer-funded welfare and other benefit programs has long been controversial.

“It was considered a non-starter for Democrats when they wrote Obamacare a decade ago, and they excluded illegal immigrants from the health law. But the party’s attitude has changed and now some Democrats are pushing to expand the 2010 law to include unauthorized migrants.

“Polling, though, suggests Americans remain opposed to public benefits flowing to illegal immigrants, and President Trump has suggested it’s time to crack down on loopholes and interpretations that have allowed them to do so.

“In the case of Section 8 housing assistance, there are competing laws that have created confusion.

“In 2017 the HUD inspector general investigated illegal immigrants in New York who were using public housing under a special program for people with HIV or AIDS, and found that the government had never clearly stated whether housing was a federal public benefit subject to a 1996 ban for unauthorized migrants.

“Further complicating matters, Clinton-era rules specifically allowed “mixed” immigration status families to gain housing benefits. As long as one person in the home is an eligible U.S. resident, a family can qualify. The eligible person doesn’t need to be the head of the household, and could even be a minor child.

“The government created a system that allows people to apply for housing assistance as “non-contending,” meaning they decline to say whether they were legally in the country. Benefits are supposed to be adjusted on a pro-rated basis to account for those non-contenders.”

The immigrant-rights activists on the left are lining up to oppose this rule as I write this. They claim that penalizing mixed-status families means hurting the legal residents in those families, who are often young children. Too bad, they are here illegally. If they want to partake of American benefits, let them become legal immigrants first, not second. This same argument is being used to debate tax credits that, while claimed on behalf of citizen children, are paid to illegal immigrant parents.

Give the GOP credit… they’ve done their best to tighten these tax rules and regulations but the obstructionist Democrats have stopped them at every turn.

Trump’s administration is making the argument that lengthy backlogs for housing assistance make the new HUD proposal an obvious change. There are millions of people waiting on that list. One in four families who would qualify for housing assistance actually get the benefit right now. Most of those waiting for HUD help are likely poor seniors or people living with a disability. These people are being hurt by those that don’t belong here legally.

“HUD intends to roll out a proposal over the next few weeks that prohibits any illegal immigrant from residing in subsidized housing, even if they are not the direct recipient of the benefit. HUD currently estimates that tens of thousands of HUD-assisted households are headed by non-citizens.

“Families who are caught gaming the system by allowing illegal immigrants to stay with them either have to comply with the new rule or they will be forced to move out of their residence.

“Households will be screened through the Systematic Alien Verification for Entitlements, or “SAVE,” program.

“An administration official told the Caller that this is a continuation of the president’s “America First” policies.”

Did you know that the average waiting time to get housing assistance in the US is now 26 months? That’s outrageous. In progressive enclaves such as Los Angeles, you can wait more than four years. All because of illegal immigrants being allowed to break our laws.

Even Cher took notice of the idiocy here in a tweet she put out this week: “I understand helping struggling immigrants,” she said, “but my city (Los Angeles) isn’t taking care of its own.” She pointed out the 50,000 citizens that are living on the streets and who are below the poverty line and go hungry. Many are veterans who served their country only to have no place to return to and no help was forthcoming. They should have just come across the border. “If my state can’t take care of its own … how can it take care of more,” Cher wondered. Good question.

Trump found himself in agreement with Cher for the first time. “This proposal gets to the whole point Cher was making,” an administration official told The Times. Yes, it does. Faster, faster pussycat.
