After Obamacare Ruled Unconstitutional – Liberals PISSED At Who Gets The Final Say

In a significant ruling Friday, a federal judge in Texas declared the Affordable Care Act, popularly known as Obamacare, to be unconstitutional in its entirety, citing a key change in the law implemented by Republicans in their big tax reform bill last year.

U.S. District Judge Reed O’Connor, a conservative George W. Bush-appointee, issued the ruling on the eve of the deadline for signing up for Obamacare coverage. His ruling is expected to be appealed, which means the conservative-majority Supreme Court, with newly appointed Justice Brett Kavanaugh, will have a chance to reassess the constitutionality of the law.

The lawsuit was brought by conservative Texas Attorney General Ken Paxton, 18 other Republican attorneys general, and one governor, the Denver Post reports. The plaintiffs argue that the law in its entirety is invalid because the removal of the penalty tax nullifies the argument used by Chief Justice John Roberts in 2012 upholding the law on the premise that the ACA is ultimately a tax and thus falls under the authority of Congress, which has “the power to impose taxes,” in this case “on those without health insurance.”

“Once the heart of the ACA — the individual mandate — is declared unconstitutional, the remainder of the ACA must also fall,” states the lawsuit, the Post notes. Democrats countering the suit claim that even though the tax is reduced to $0.0, it still remains a hypothetical tax.

In his ruling Friday, O’Connor agreed with Republicans that with the tax aspect of the law scheduled for elimination starting January 2019, the 2012 ruling’s defense of the law is invalidated, making the entire law unconstitutional.

“The remainder of the ACA is non-severable from the individual mandate, meaning that the Act must be invalidated in whole,” wrote O’Connor in his 55-page opinion, Bloomberg reports.

The Post reports that in a court brief, Justice Department officials “contended that, once the insurance mandate’s penalty is gone next month, that will invalidate the ACA’s consumer protections, such as its ban on charging more or refusing to cover people with preexisting medical conditions.” However, the Trump administration officials said that many parts of the law could continue to remain in place.

The dismantling of Obamacare has been one of President Trump’s top priorities since taking office. In October 2017, Trump signed an executive order designed to expand health insurance options, in part as a means of providing alternatives to Obamacare.

Trump responded to O’Connor’s ruling in a series of celebratory tweets Friday.

“As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster! Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!” he wrote. “Wow, but not surprisingly, ObamaCare was just ruled UNCONSTITUTIONAL by a highly respected judge in Texas. Great news for America!”

Kamala Just Made Shocking Sudden Border Announcement – Beto & Gillibrand Panicking

Democratic California Sen. Kamala Harris refuted two of her potential 2020 presidential primary challengers on Wednesday when she stated that she does not agree with their acceptance of open borders.

“No, I believe that we need border security,” Harris told “The Daily Show’s” Trevor Noah when asked how she felt about former Texas Rep. Beto O’Rourke’s call to remove the already standing wall along the U.S.-Mexico border.

“We need smart border security. We can’t have open borders, we need to have border security, all nations do,” she continued. “All nations define their borders, but we should not have a policy and perspective that is grounded in keeping people out for the sake of this nationalistic kind of thing this president is trying to push.”

O’Rourke has long argued against a border wall, despite still claiming to be against open borders. Following President Donald Trump’s executive order in September to erect an 18-foot steel bollard wall to replace the existing pedestrian fencing in El Paso, Texas, the Democrat called the existing chain-link fence “bad enough.”

The failed senatorial candidate later revealed to MSNBC’s Chris Hayes that if he could snap his fingers and make his hometown of El Paso’s border wall disappear, he “absolutely” would. O’Rourke insisted in the past that the way to improve border safety and security is to “ensure that we are maximizing the potential from everyone … [and] treating each other with respect and dignity” and referred to Trump’s wall as an “expression of our smallness, our meanness, our fear to the rest of the world.”

Democratic New York Sen. Kirsten Gillibrand, who launched a presidential exploratory committee in January, signaled her support for tearing down the existing barrier on the border when she was confronted with O’Rourke’s position.

“Well, I’d have to ask folks in that part of the of the country to see whether the fencing that exists today is helpful or unhelpful,” Gillibrand replied in February when asked about O’Rourke’s comments. “But, you know, Democrats are not afraid of national security or border security.”

“And [the wall] is a hateful message. I mean [Trump’s] trying to create a picture of division and hate and derision. And that’s what I’m so offended by — the fact that he’s fused this kind of racism in, ‎in his words and actions is just troubling,” she continued. “So, I could look at it and see which part he means and why and if it makes sense I could support it.”

Neither Gillibrand nor O’Rourke have officially entered the 2020 presidential race.

Trump Just Blindsided Congress By Demolishing New Plan To Stop Border Wall

Democrats thought they could open the border up – but Donald is ready for them.

The wall is getting built whether the Left likes it or not.

Trump has made it clear that he is going to do whatever it takes to protect the country, and has declared a National Emergency at the border to get the funds necessary to build the wall.

Anyone with common sense can see the border crisis is an emergency—am I right?! Every day, drugs and criminals are pouring in and putting American lives at risk.

But the Democrats don’t care and are determined to keep fighting against the country’s interests.

Time Magazine reports:

House Democrats plan to file a resolution as soon as Friday that’s aimed at blocking President Donald Trump’s declaration of an emergency at the Southwest border.

Passage by the Democratic-run House seems likely. The measure would then move to the Republican-controlled Senate, where there may be enough GOP defections for approval.

Trump has promised a veto, which would be difficult for Congress to override.

Trump predicted the Democrats would try to block his emergency declaration, and once again he’s been proven right.

But the President also predicts that he will win if the case makes it to the Supreme Court, just like he won the travel ban case.

Even if the resolution to block the declaration makes it through the House and Senate, the President will veto it, and there’s no way the resolution will make it through with a Republican majority.

Rep. Jim Jordan told reporters that he believes there are enough GOP votes in Congress to prevent the two-thirds supermajorities required to overcome a veto in both the House and the  Senate.

“I think there are plenty of votes in the House to make sure that there’s no override of the president’s veto,” he said. “So it’s going to be settled in court, we’ll have to wait and see.”

Liberals may not care about saving American lives, but Trump will shut down any effort they make to keep our border unsecured.
